External Force Investigation Team (EFIT) Issues Seventh Quarterly Report

On June 6, 2023, Darryl Neier (EFIT Administrator) and William Hurlock (Deputy Administrator) presented the External Force Investigative Team 7th Quarterly Report (Doc. 995) in an all-day hearing before the Honorable United States District Judge James Browning, District of New Mexico.

Judge Browning took testimony from the United States Department of Justice, Independent Monitor and Albuquerque Police and EFIT, related to the Independent Monitor Report (IMR17) https://www.cabq.gov/police/documents/imr-17-doc-990.pdf

Mr. Neier stated he is, “proud to be part of an amazing group of professionals working toward a common goal of constitutional policing and transitioning the oversight function of EFIT back to Albuquerque Police.”

Among the numerous accomplishments to date, the EFIT Team reported that it is transitioning IAFD Detective / Investigators to conduct interviews without EFIT’s direct supervision or oversight. The team has also reduced the of EFIT Investigators per team for callout and interviews and transitioned their investigators to EFIT 2.

The External Force Investigative Team 7th Quarterly Report also states:

“Between July 16, 2021, and June 1, 2023, EFIT/IAFD responded to, and are investigating and / or monitoring, a total of 859 Use of Force (UOF) incidents. These investigations are completed in an average of 54.16 days. In addition, 715 UOF investigations were closed, 24 averaging a total of 87.01 days for closure; all under the time constraints of the Amended Stipulated Order of 90-Days. Supervisor reviews average 18.56 days. Of the UOF cases closed (715), 46 UOF cases were out of APD Policy (6.43%) 26 and 149 of the 715 investigations(20.83%) failed to comply with the Process Narrative. These overall numbers improved dramatically over the past three quarters.There were no violations of the Process Narrative this reporting period.
