External Force Investigation Team (EFIT) Issues Eighth Quarterly Report

On September 21, 2023, EFIT issued the Eight Quarterly Report (Doc. 1014) to the United States DistrictCourt for the District of New Mexico.
As of this report, and cumulatively since EFIT went live in July 2021, 50 out of the 991 (5.04%) UOF investigations closed by EFIT/Internal Affairs Force Division (“IAFD”) were found not within the Albuquerque Police Department (“APD”) use of force (“UOF”) policies (this is a 1.39 decrease from what was reported in the previous quarterly report). Most significantly, 157 out of the 991 (15.84%) of the UOF investigations closed by EFIT/IAFD were out of compliance when evaluated against the Process Narrative (Doc. 862)4 utilized to assess investigations (this is a cumulative reduction of 4.99% from what was reported in the previous quarterly report).
Darryl Neier (EFIT Administrator) has stated that “IAFD has made significant progress, and we are continuing with the transition process that will provide APD a sustainable division that will continue to investigate UOF incidents without EFIT oversight and mentorship.” Mr. Neier further stated, “he is very proud of the men and woman of APD and the members of his EFIT team”
